Beyond the daily communication value of silence and even as perpetuating factor of the notion in all social fields, the present study is based upon the different meanings of silence in the legal area. Since Antiquity and until, the concept of silence had numerous meanings poving the importance given to this topic. Philosophers, artists, monarchs and legal experts have looked into the subject being fascinated by the amplitude and the effects shown by ”some-thing” we can’t see, hear or touch, meaning something totally exterior to any form of sense perception. This study analyses how the elements of this form of communication are being transformed into legal provisions, both in public and private law, as well in the Romanian and international legal systems.
