Simona GHERGHINA, Limits for Using Indirect Public Guarantees for Financing Public Investments
The contracts providing private financing of public investments may include certain obligations having similar effects to direct, expressly undertaken, public guarantees.

Although not specifically regulated, the potential effects of such indirect guarantee mechanisms are triggering the application of general rules. These rules are providing for several types of limitations which are to be considered by public legal persons when undertaking such obligations, at least up to the moment of their specific regulation.
