Controverse privind promisiunea sinalagmatică de vânzare în reglementarea Noului Cod Civil- Maria - Cristina Mihuț
Abstract: The present paper proposes a comparative and historic analysis of the institution of sale promise, analysis which defers to the doctrine and practice founded on the Old Civil Code and at the reglementations of the New Civil Code.
Promissory sale agreement has represented, under the enforcement of the Old Civil Code, and will continue to represent an institution very frequently used in practice.
Some of the controversy existing under the old enforcement, or more appropriately, unenforcement, have been cleared by the New Civil Code, others have been born. From these, I have chosen to analyze the form of promissory sale agreement.
