The EU accession to the ECHR and the relationship between the Charter of fundamental rights of the European Union and the European Convention for the Protection of Human Rights and Fundamental Freedoms - Armanu Andreea Paula
Abstract: This article deals with the issue of the European Union’s accession to the European Convention for the Protection of Human Rights and Fundamental Freedoms starting with the intentions of accession and continuing with the current phase of the negotiations. Considering the importance and the complexity of this moment in the history of EU law, its consequences should be observed from the point of view of the Court of Justice of the European Union involvement, but also from the point of view of compatibility of EU acts with the European Convention for the Protection of Human Rights and Fundamental Freedoms.  The fact that since the Lisbon Treaty the Charter of Fundamental Rights of the European Union has the same value like the EU treaties raises some questions concerning the coexistence of the two catalogs of human rights in European space.
