The enactment of a personal insolvency procedure – a matter of legal or social responsibility of the Romanian state - Stela Pelican
Abstract: This paper aims to analyze a subject which has been less touched upon in the professional literature, despite its topicality and intricacy  - the necessity of the Romanian state to enact a personal insolvency procedure. The paper will analyse the historic evolution of the insolvency of natural persons who do not deploy economic activities independently in the Romanian law and shall provide an answer to the question of whether the Romanian state faces a legal obligation to enact a personal insolvency procedure, taking into account the Council Regulation no. 1346/2000, or a mere social obligation, in view of the national economic situation.
