The protection of fundamental rights as a cause of the constitutionalisation of European Law - Caramihai Georgiana-Iulia
Abstract: The purpose of the following paper is to study the phenomenon of constitutionalizing the European law, taking into account its evolution up to this point and the controversies related to the application of the concept of Constitution in another context than the national one. As a result, it can be remarked that the judicial protection of fundamental rights can have – among its consequences - the role of constitutionalizing the international judicial order. In order to verify this hypothesis, the following paper is going to analyze if the codification and, implicitly, the protection of fundamental rights can constitute a strong enough telos for the member states, in order to conduct to the development of common values and the evolution in the process of the constitutionalisation of European law.
