The right to conscientious objection and the patient’s rights to medical services for reproductive health – does the Romanian legislation protect sufficiently these two rights? - Ana-Maria Ghineţ
Abstract: The increasing availability of reproductive health services has led to conflicts between the right of patients to medical services for reproductive health and the right of medical staff to freedom of conscience and religion. A comprehensive regulation of conscientious objection is the legal “universal medicine” which can solve these conflicts. This article discusses the legal nature, the scope and the limits of conscientious objection, its regulation by art.9 ECHR and Romanian legislation and proposes improvements in the Romanian legislation for its conformity with European standards.
