Bogdan AURESCU, Chargé des cours, docteur en Droit, « Le Concept de la Politique Nationale d’État » de la République de Moldavie. L’identité nationale et le concept européen de la nation
The quest for a specific, unique State identity – and consequently for a specific, unique national identity – is a common feature for all newly established States, including for Republic of Moldova. In some cases, at a certain early stage of State identity building process, some States prefer to adopt pieces of legislation in order to promote and implement the features of a certain State identity. It is also the case of Republic of Moldova, which adopted in December 2003, by Organic Law, the “Concept of State National Policy”. This article proposes an analysis of this “Concept…” in the light of the debate on the concept of “nation” at European level, which has not only a history of its own, but also a contemporary dimension, the latest manifestation of which being the adoption by the Parliamentary Assembly of the Council of Europe of the Recommendation No. 1735 (2006) on “the concept of ‘nation’”. This document proposes, inter alia, an approach that may justify the relationship between a “kin-majority” and another “kin-majority” (in other words, between two States kin to each other) on the basis of the close link of two components of the (previous) cultural/ethnic nation. It is the case, among others, of the actual situation of Romania and the Republic of Moldova.
