According to the express constitutional rules, relations between international conventional law of human rights and national Romanian law are governed by the principles of self-executing, superiority (interpretative constitutional value and supra-legislative force) and subsidiary application of international conventional rules.

As for the international case-law of human rights, same principles apply, according to concurring general case-law of the two supreme courts of Romania - the constitutional one and the judiciary one.
