Abstract: Academic freedom for academics and university autonomy together constitute the university freedoms born of the European tradition and represent important democratic values. These two values are autonomous, but they act together and normally live in peace, although conflicts between them cannot be excluded. As these two values are hierarchical, and despite the fact that in Romanian law it is only university autonomy that has an express constitutional consecration and is qualified as a component element of the fundamental right to education, European human rights law enshrines academic freedom as a human right, so it is this value that must be preferred in the event of conflict with university autonomy, while preserving the fair balance between the interests involved.
