Abstract: From a
jurisprudential perspective, we will approach the relevance of the name of a
colour describing aspects related to the definition of the name from a
dictionary and the meaning of the distinctive character. The analysis will be
drawn taking into consideration the case Off-White LLC v. EUIPO highlighting
the symbolic value of trademark and colour name in the frame of two main verbs
(to differentiate and to identify) that establish the functions of a trademark.
