The protection of the marine environment against pollution by hydrocarbons is carried out by two categories of international instruments: ones having a universal vocation, others having a regional vocation.
Those of the first category are characterized by a broad territorial application, which contrasts with a more restricted materielle application (limited to certain polluting agents or certain sources of pollution). From the point of view of their finality, these instruments can be classified in two categories: International Conventions devoted to the prevention of the pollution of the marine environment, International Conventions devoted to the co-operation for the limitation or the elimination of the effects of the pollution of the marine environment and International Conventions instituting of mechanisms of engagement of the responsibility for the damage caused by pollution to the marine environment (the latter intruments were not the subject of this study).
The instruments forming part of the second category apply to a specific maritime basin (limited territorial application), instituting, in general, rules aiming at the same time the prevention of pollution and its limitation/elimination, whatever the source of pollution and the nature of the pollutant (unlimited material application).
