This paper provides an analysis the compatibility of amnesty measures adopted by certain states from Europe, Africa and, South-America with the necessity to determine criminal liability – either in front of the national jurisdictions, or in front of certain international jurisdictions – of persons suspected to have committed international crimes. It outlines the phenomenon of „truth and reconciliation commissions” as an alternative to judicial procedures in post-conflict societies, particularly in certain states from Latin America.
