Cătălin-Nicolae CONSTANTINESCU, The Conventional and Doctrinal Evolution of the Notion of Crimes against Humanity
Abstract: Crimes against humanity have met and continue to meet a double
evolutionary process. On the one hand, doctrine and international instruments
have shaped and promoted the concept amidst the international community. On the
other hand, the development of relevant jurisprudence by the practice of
international criminal courts has provided the necessary tools for the constant
improvement of the concept.
This paper focuses on the
evolution of the concept of crimes against humanity from a conventional point
of view, in direct relation with domestic or international conflicts, starting
with the first mention of the notion and ending with the Rome Statute.
