Corneliu-Liviu POPESCU, Ph.D. in Law, Professor, Domestic legal consequences of Romanian state' sanction by the European Court of Human Rights
In order to ensure the execution of the sanctioning judgments of the ECHR, Romanian State adopted domestic legal rules, especially concerning the payment of the equitable satisfaction compensation and the re-opening of the domestic judicial procedures (as individual measures of execution), as well as the changing of the un-conventional legislation and the publicity of the sanctioning judgments (as general measures). Besides, there are legal rules concerning the recovery of the State's prejudice and the sanction of the guilty persons. However, this legislation is incomplete and its enforcement is imperfect.
