Part III

Ioan MURARU, Professor, Ph. D., Faculty of Law, University of Bucharest, A Few Considerations on the Custody of a Person in the Decision n° 799/2011 of the Romanian Constitutional Court
The security of the person, often considered as a fundamental right, is in the Romanian constitutional system a guarantee of all fundamental rights. This entails the fact that no revision in the direction of its restriction can be made; the contrary would have the significance of a serious infringement of article 152 para.2 of the Constitution regarding the limits set for constitutional revisions. Constitutional judges, in the decision mentioned, have done a regrettable mistake.

Key-words: fundamental rights, restriction, the security of the person, revision of the Constitution, limits, decision of constitutionality
