This paper analysis hard-cases and leading-cases in Brasil that deal with the issue of the fidelity that judges have  with regard to the Constitution and the law, as well as the use they may have of ethic and political values and, finally, of facts when taking a judicial decision. Such choices seem to be more difficult when they refer to the right to education and include a racial quota issue.
