The constitutional principle of proportionality predetermines the possibility of the constitutional judge to check upon facts. The respect of the principle of proportionality lato sensu involves a successive control of the possibility to accomplish any given goal through the chosen means, of the existence of alternative means less restrictive for the fundamental rights, and of the balance (proportionality stricto sensu) stricken between public and private interests at stake. This paper analyses the foundation of the principle of proportionality in Russian constitutional law (1), its material elements (2), and the limits of its application by the Constitutional Tribunal of the Russian Federation (3).
